Mark Kelly, D-Ariz., may have violated his oath with comments he made to a news outlet following a classified briefing.<\/p>\n<p>Kelly told Margaret Brennan on Face the Nation that it is \u201cshocking how deep we have gone into these magazines\u201d when asked if the Pentagon has updated lawmakers on the Iran war\u2019s impact on US weapons stockpiles.\u00a0<\/p>\n<p>The senator told Brennan the Tomahawks, Army Tactical Missile System (ATACMS), RIM-161 Standard Missile 3 (SM-3), Terminal High Altitude Area Defense (THAAD) rounds and Patriot rounds used to defend the US have been hit hard, adding that it will take years to replenish those stockpiles, which could affect a hypothetical US conflict with China.<\/p>\n<p>In response, Hegseth questioned whether Kelly, a former Navy pilot, may have violated his oath and said the Pentagon\u2019s legal counsel will review his comments.<\/p>\n<p>\u201c\u2018Captain\u2019 Mark Kelly strikes again,\u201d Hegseth wrote on X.<\/p>\n<p>\u201cNow he\u2019s blabbing on TV (falsely &amp; dumbly) about a *CLASSIFIED<em>*<\/em>\u00a0Pentagon briefing he received,\u201d he continued. \u201cDid he violate his oath\u2026 again? @DeptofWar legal counsel will review.\u201d<\/p>\n<figure class=\"nyp-slideshow-modal-image wp-block-image aligncenter size-large\"><figcaption>Defense Secretary Pete Hegseth speaks to members of the media during a press briefing at the Pentagon in Washington, Tuesday, May 5, 2026. <span class=\"credit\">AP<\/span><\/figcaption><\/figure>\n<p>The senator clapped back, saying Hegseth had revealed similar information at a recent hearing and that it was not classified.<\/p>\n<p>\u201cWe had this conversation in a public hearing a week ago and you said it would take \u2018years\u2019 to replenish some of these stockpiles,\u201d Kelly responded on X. \u201cThat\u2019s not classified, it\u2019s a quote from you. This war is coming at a serious cost and you and the president still haven\u2019t explained to the American people what the goal is.\u201d<\/p>\n<p>This comes amid a months-long dispute between Hegseth and Kelly over the senator\u2019s participation in a video with some of his Democratic colleagues in Congress urging US military members to ignore \u201cillegal\u201d orders.<\/p>\n<p>The DOJ has opened an investigation into the video posted online featuring six Democratic lawmakers calling on troops and members of the intelligence community to defy illegal orders from the federal government. The lawmakers all served in the military or at intelligence agencies.<\/p>\n<figure class=\"nyp-slideshow-modal-image wp-block-image aligncenter size-large\"><figcaption>Sen. Elissa Slotkin of Michigan, as well as Reps. Chris Deluzio and Chrissy Houlahan of Pennsylvania, Maggie Goodlander of New Hampshire and Jason Crow of Colorado.<\/p>\n<p>\u201cThis administration is pitting our uniformed military and intelligence community professionals against American citizens,\u201d the lawmakers said in the video. \u201cLike us, you all swore an oath to protect and defend this Constitution. Right now, the threats coming to our Constitution aren\u2019t just coming from abroad but from right here at home. Our laws are clear. You can refuse illegal orders. You must refuse illegal orders. No one has to carry out orders that violate the law or our Constitution.\u201d<\/p>\n<p>Grand jurors declined to sign off on charges against the lawmakers in February.<\/p>\n<figure class=\"nyp-slideshow-modal-image wp-block-image aligncenter size-large\"><figcaption>Hegseth questioned whether Kelly, a former Navy pilot, may have violated his oath and said the Pentagon\u2019s legal counsel will review his comments. <span class=\"credit\">Getty Images<\/span><\/figcaption><\/figure>\n<p>In November, the Pentagon launched an investigation into Kelly, pointing to a federal law that allows retired service members to be recalled to active duty on orders of the secretary for possible court-martial or other punishment.<\/p>\n<p>Hegseth has censured Kelly\u00a0and has attempted to retroactively demote him from his retired rank of captain over his participation in the video, which affirms that refusing unlawful orders is a standard part of military protocol.<\/p>\n<p>But a federal court ruling blocked the Pentagon from demoting the lawmaker over the video. The court also found the Pentagon likely violated Kelly\u2019s First Amendment rights, and those of \u201cmillions of military retirees,\u201d when it formally censured him on Jan. 5.<\/p>\n<figure class=\"nyp-slideshow-modal-image wp-block-image aligncenter size-large\"><figcaption>Trump, flanked by Hegseth, speaks during a press conference in the James S. Brady Press Briefing Room at the White House in Washington, DC, on April 6, 2026.  <span class=\"credit\">REUTERS<\/span><\/figcaption><\/figure>\n<p>Hegseth subsequently appealed that ruling.<\/p>\n<p>Last week, a three-judge panel of the US Court of Appeals for the DC Circuit heard oral arguments and appeared largely skeptical of Hegseth\u2019s attempt to punish Kelly for the video.<\/p>\n<p>\u201cI will not back down from this fight,\u201d Kelly said after the hearing.<\/p>\n<p>President\u00a0Donald Trump\u00a0had accused the lawmakers of being \u201ctraitors\u201d who engaged in \u201csedition at the highest level\u201d and \u201cshould be in jail\u201d after the video was posted last fall.
