Joni Ernst (R-Iowa) and Kirsten Gillibrand (D-NY) have teamed up on the \u201cNo Taxpayer-Funded Pensions for Sex Criminals Act\u201d in the aftermath of rape and sexual misconduct accusations that forced  Rep. Eric Swalwell (D-Calif.) to resign last month.<\/p>\n<p>\u201cThere should be absolutely no room for the tolerance of egregious sex crimes,\u201d\u00a0Ernst, herself a sexual assault survivor, said in a statement.\u00a0\u201cAllowing proven predators to continue collecting their pensions on the taxpayer\u2019s dime only serves to greenlight unacceptable behavior.\u201d<\/p>\n<p>Five women have accused Swalwell of sexual harassment or abuse, with two claiming the married 45-year-old had raped them. The Manhattan District Attorney\u2019s Office and Los Angeles County Sheriff\u2019s Department are investigating those claims, while the Justice Department has confirmed it is probing possible illegal acts by Swalwell in DC<\/p>\n<figure class=\"nyp-slideshow-modal-image wp-block-image aligncenter size-large\"><figcaption>The legislation would stop taxpayer dollars from going to fund pensions for individuals convicted of sex crimes. <span class=\"credit\">CQ-Roll Call, Inc via Getty Images<\/span><\/figcaption><\/figure>\n<figure class=\"nyp-slideshow-modal-image wp-block-image aligncenter size-large\"><figcaption>Former Rep. Eric Swalwell has lawyered up and is facing multiple criminal investigations over rape accusations against him. <span class=\"credit\">AFP via Getty Images<\/span><\/figcaption><\/figure>\n<aside class=\"single__inline-module aligncenter wp-block-nypost-editor-primary-tag\">\n<\/aside>\n<p>Swalwell has denied criminal wrongoing, but copped to \u201cmistakes in judgment\u201d in statements ending his California gubernatorial campaign April 12 and resigning from the House of Representatives two days later.<\/p>\n<p><span style=\"margin: 0px;padding: 0px\">Currently,\u00a0Swalwell is still eligible for a congressional pension once he turns 62, with estimates pegging the giveaway at\u00a0more than $22,000\u00a0annually.<\/span><\/p>\n<p>Under current law, legislators who attain five years of service are eligible for the benefit. Swalwell was first elected to Congress in 2012.<\/p>\n<p>On average, lawmakers get an annuity of about $45,276, though longer-serving members earn even more. Annual benefits for current and former lawmakers cost taxpayers about $38 million.<\/p>\n<figure class=\"nyp-slideshow-modal-image wp-block-image aligncenter size-large\"><figcaption>Sen. Kirsten Gillibrand has spent much of her time in the Senate trying to reform the military\u2019s handling of sexual assault cases. <span class=\"credit\">AP<\/span><\/figcaption><\/figure>\n<p>\u201cIt\u2019s outrageous that federal employees convicted of sex crimes are eligible to collect their taxpayer-funded pension,\u201d\u00a0said Gillibrand, who led the push to give independent prosecutors the power to try cases of sexual assault in the military, taking charging decisions away from the chain of command.<\/p>\n<p>\u201cThe bipartisan\u00a0No Taxpayer-Funded Pensions for Sex Criminals Act\u00a0ensures that no hard-earned taxpayer dollars are spent supporting criminal sex offenders. I\u2019m proud to support this commonsense bill that will provide much-needed accountability.\u201d\u00a0<\/p>\n<p>On the same day Swalwell quit Congress, Rep. Tony Gonzales (R-Texas) also stepped down to avoid possible expulsion.<\/p>\n<figure class=\"nyp-slideshow-modal-image wp-block-image aligncenter size-large\"><figcaption>Former Rep. Tony Gonzales had pestered subordinates for lewd pictures.  <span class=\"credit\">CQ-Roll Call, Inc via Getty Images<\/span><\/figcaption><\/figure>\n<p>Disturbing text messages had emerged in recent months showing Gonzales, a married father of six, pressing staffers for \u201csexy\u201d pictures and nudes.<\/p>\n<p>One of those aides, Regina Ann Santos-Aviles, died after lighting herself on fire in September 2025. Another staffer, Gonzales\u2019 former political director, repeatedly rejected his sexual overtures.<\/p>\n<p>Unlike Swalwell, Gonzales is not eligible for a pension because he didn\u2019t hit five years of service in Congress.<\/p>\n<p>Both men retain other perks such as membership in the congressional gym and access to the House floor.<\/p>\n<p>Rep. Zach Nunn (R-Iowa) had previously introduced legislation to stop expelled lawmakers from collecting taxpayer-funded pensions.\u00a0<\/p>\n<p>That pitch came in response to the expulsion of lying Long Island Rep.
