Kathy Hochul to pardon ex-NYPD Sgt.\u00a0Erik Duran\u00a0of his manslaughter conviction \u2013 slamming the case against him as a \u201cblatant miscarriage of justice.\u201d<\/p>\n<p>GOP state Assemblyman Matt Slater sent Hochul the letter, signed by nearly 40 of his colleagues, pleading with her to grant clemency to Duran, who was sentenced to at least three years behind bars for fatally flinging a cooler at a fleeing drug suspect.<\/p>\n<p>\u201cAt a time when law enforcement officers are asked to make split-second decisions to keep our communities safe, we must also ensure they are treated with fairness when those decisions are made in good faith,\u201d wrote Slater, whose district includes Duran\u2019s Putnam County home.<\/p>\n<figure class=\"nyp-slideshow-modal-image wp-block-image aligncenter size-large\"><figcaption>Ex-NYPD Sgt. Erik Duran in court for his sentencing. <span class=\"credit\">Matthew McDermott for NY Post<\/span><\/figcaption><\/figure>\n<p>\u201c[Duran\u2019s] actions were taken in the line of duty to protect others from immediate harm, and we believe justice and fairness warrant your consideration,\u201d the Tuesday letter states.<\/p>\n<p>The Bronx native, a 13-year veteran of the NYPD, was charged by the state Attorney General\u2019s Office after he threw a full Igloo cooler at 30-year-old Eric Duprey during an undercover drug sting in August 2023.<\/p>\n<aside class=\"single__inline-module aligncenter wp-block-nypost-editor-primary-tag\">\n<\/aside>\n<p>Duprey, who was trying to flee arrest on a motorbike, crashed and hit the ground, suffering fatal injuries, authorities have said. <\/p>\n<p>\u201cUnfortunately, Mr. Duprey \u2026 who was not wearing a helmet, was killed,\u201d the pols wrote in their letter.<\/p>\n<p>While Duran argued that he threw the picnic equipment to protect his fellow officers and others in the path of the moped, Bronx Supreme Court Justice Guy Mitchell found the lethal force not justified and convicted him of  second-degree manslaughter in February, following a non-jury trial.<\/p>\n<p>\u201cWe believe this entire proceeding was a blatant miscarriage of justice,\u201d Slater\u2019s letter states.<\/p>\n<p>\u201cSgt. Duran\u2019s actions saved the lives of innocent civilians nearby, his officers, and their prisoner.\u201d<\/p>\n<p>Mitchell, on April 9, sentenced the ex-cop \u2014 a married 38-year-old father of two \u2014 to a 3-to-9 year prison term, while saying he wanted the punishment to be a \u201cdeterrent\u201d to other officers.<\/p>\n<p>\u201cA deterrent to what\u2014doing their jobs? It\u2019s absurd,\u201d Assembly Minority Leader Ed Ra (R-Franklin Square) said in a statement accompanying the letter. <\/p>\n<p>\u201cThis is not the world we have to live in. Gov. Hochul has the authority to correct this injustice and restore balance to our system. New York should be a place where criminals are held accountable and police are supported in protecting the public. Granting Sgt. Duran a pardon would send a clear message that public safety still matters.\u201d<\/p>\n<p>Duran, who was fired by the NYPD upon his conviction, spent a week behind bars before\u00a0an appeals court agreed to free him on $300,000 bail while he fights to overturn the guilty verdict.<\/p>\n<p>The letter pleading for clemency for him was signed by 38 Republican assembly members after it was circulated among the GOP conference.<\/p>\n<p>Hochul\u2019s office has said Duran needs to apply for a pardon if he wants his case to be considered.<\/p>\n<p>\u201cThere is a pardoning process in the state of New York and we review all applications that come before the administration impartially,\u201d a spokesperson reiterated Thursday.\u00a0<\/p>\n<p>Duran\u2019s legal team has yet to apply for a pardon, a rep for the NYPD\u2019s Sergeants Benevolent Association said Thursday.<\/p>\n<p>One of his lawyers, Arthur Aidala, told The Post that Duran\u2019s legal team is focused on working on his appeal, but still leaving other options open.<\/p>\n<p>\u201cRight now, our undivided attention is on submitting the appeal and righting this wrong that was done to Sgt. Duran,\u201d Aidala said, adding. \u201cHowever we\u2019re not ruling anything out and we will continue to explore all of our options.\u201d<\/p>\n<figure class=\"nyp-slideshow-modal-image wp-block-image aligncenter size-large\"><figcaption>Assemblyman Matt Slater speaks at a news conference. <span class=\"credit\">Albany Times Union via Getty Images<\/span><\/figcaption><\/figure>\n<p>Slater told The Post on Thursday that Duran\u2019s predicament \u201csends a really disheartening and concerning message to law enforcement all across New York.\u201d<\/p>\n<p>\u201cOne that I\u2019ve heard from law enforcement officers about and we need to make sure they understand that we recognize the dangerous situation that they get put in,\u201d he said.<\/p>\n<p>Slater, who began serving in the assembly in 2023, noted the lawmakers who signed onto his letter came from across the Empire State \u2014 emphasizing the widespread support for Duran.<\/p>\n<p>\u201cIt sends a strong message that we\u2019ve got representatives from every corner of the state that recognize the injustice that\u2019s been done here,\u201d he said.<\/p>\n<figure class=\"nyp-slideshow-modal-image wp-block-image aligncenter size-large\"><figcaption>New York Governor Kathy Hochul <span class=\"credit\">Stephen Yang for NY Post<\/span><\/figcaption><\/figure>\n<p>\u201cTo have an activist judge try to send a message to law enforcement in this way is just patently wrong.\u201d<\/p>\n<p>Nassau County Executive Bruce Blakeman, a Republican running for governor against Democratic incumbent Hochul this year, has said he will\u00a0pardon Duran if elected to the state\u2019s highest office.<\/p>\n<p>Duran, in a statement released by the SBA after he was released on bail last week, said he was ready to fight \u201cmy appeal with the same determination I demonstrated throughout my career in the NYPD.\u201d<\/p>\n<p>The union and the National Police Defense Foundation are working together to raise funds to help with Duran\u2019s legal fees.\u00a0<\/p>\n<\/p><\/div>\n<p><!-- \u603b\u5bb9\u5668\uff1a\u6700\u5927\u5bbd908px Grid\u7d27\u51d1\u5e03\u5c40 -->\r\n<div style=\"display: grid;
