Jay Obernolte penned a letter to Governor Gavin Newsom demanding answers and transparency regarding revelations of rampant hospice fraud.  <span class=\"credit\">Michael Brochstein\/ZUMA \/ SplashNews.com<\/span><\/figcaption><\/figure>\n<p>At the center of GOP lawmakers concerns is the lack of safeguards, and the apparent failure from the state to adopt emergency regulations despite a mandate from the legislature to do so following a 2022 state audit report.<\/p>\n<p>\u201cThey\u2019re lifting the moratorium without putting in new guidelines, so we want to know why that is and we\u2019re asking some pointed questions about that,\u201d Congressman Jay Obernolte told The Post.\u00a0<\/p>\n<figure class=\"nyp-slideshow-modal-image wp-block-image aligncenter size-large\"><figcaption>California Governor Newsom denies widespread fraud, and frequently points to a 2022 moratorium he signed on new hospice licenses.  <span class=\"credit\">Getty Images<\/span><\/figcaption><\/figure>\n<aside class=\"single__inline-module aligncenter wp-block-nypost-editor-primary-tag\">\n<\/aside>\n<p>Newsom issued a moratorium on hospice licenses following the audit, but the emergency regulations intended to strengthen oversight and regulations that were filed in December of 2025 were withdrawn just days later, according to the letter. \u00a0<\/p>\n<p>While the letter notes emergency regulations seem to be actively adopted, they have not been formally re-submitted \u2014 instead, the moratorium has been extended through 2027.\u00a0<\/p>\n<p>\u201cGavin Newsom has been asleep at the wheel and failed to protect California taxpayers from fraud on a massive scale,\u201d Congressman Ken Calvert said. \u201cWe need California to wake up and take action to stop this fraud.\u201d\u00a0<\/p>\n<p>A sentiment echoed by Congresswoman Young Kim, who also signed the letter and called out state leadership for \u201clooking the other way.\u201d\u00a0<\/p>\n<p>\u201cWhile hardworking Californians are struggling to make ends meet, the hospice fraud business seems to be booming,\u201d she said, adding that \u201csomeone has to hold Sacramento accountable, and that\u2019s exactly what we\u2019re doing.\u201d\u00a0<\/p>\n<figure class=\"nyp-slideshow-modal-image wp-block-image aligncenter size-large\"><figcaption>Congresswoman Young Kim said state leadership is \u201clooking the other way\u201d when it comes to fraud.  <span class=\"credit\">Getty Images for Concordia Annual Summit<\/span><\/figcaption><\/figure>\n<p>This is the second later in as many months, as House Oversight Committee Chair James Comer announced a probe into \u201crampant\u201d hospice fraud in California back in March \u2014 calling out Newsom and the state for having a \u201cwell-documented history of fraud in its hospice programs\u201d and estimated the total amount at over $105 million.<\/p>\n<p>The California GOP\u2019s letter comes as hospice fraud has taken center stage in the Trump administration\u2019s mission to root out waste, fraud and abuse.\u00a0<\/p>\n<p>Earlier this month, a California Post investigation revealed a network of suspicious doctors who appear to be driving tens of millions of questionable billing in\u00a0California\u2019s hospice system and led to Dr. Fariba Javaherian, a registered dermatologist, losing her license to bill Medicare along with 16 hospice facilities.\u00a0<\/p>\n<figure class=\"nyp-slideshow-modal-image wp-block-image aligncenter size-large\"><figcaption>Congressman Ken Calvert told The Post Newsom \u201cfailed to protect California taxpayers.\u201d  <span class=\"credit\">CQ-Roll Call, Inc via Getty Images<\/span><\/figcaption><\/figure>\n<p>Javaherian was associated with 63\u00a0hospice facilities across California\u00a0either as a medical director, attending physician or in some other capacity and appeared on more than 6,000 claims that billed $35,816,331, according to CMS billing data obtained by The Post.\u00a0<\/p>\n<p>Federal authorities also launched a series of raids in April targeting people accused of health care fraud, resulting in the arrests of eight people including three nurses, a chiropractor and a psychologist, who all face federal charges for allegedly scamming the nation\u2019s health care system of more than $50 million.\u00a0<\/p>\n<p>\u201cWe all have an interest in making sure taxpayer dollars are wisely and appropriately spent,\u201d Obernolte said. \u201cEveryone loses when we allow fraudsters to take those dollars away from the people who are legitimately entitled to them.\u201d<\/p>\n<\/p><\/div>\n<p><!-- \u603b\u5bb9\u5668\uff1a\u6700\u5927\u5bbd908px Grid\u7d27\u51d1\u5e03\u5c40 -->\r\n<div style=\"display: grid;
