Abigail Spanberger said during her 2025 campaign, \u201cI have no plans to redistrict Virginia\u201d \u2014 then backed the move once in office. <span class=\"credit\">Bloomberg via Getty Images<\/span><\/figcaption><\/figure>\n<p>A constitutional amendment was needed to put it to voters \u2014  and state lawmakers have to approve a resolution in two consecutive legislative sessions, with an election in between, to do so.<\/p>\n<p>Democrats claimed they met that requirment thanks partly to a special session last year that they contend was left open from 2024 and resumed again in the normal session in 2025. Republicans are arguing that such a special session doesn\u2019t count as two sessions.<\/p>\n<p>Additionally, the state legislature\u2019s first vote on the proposed amendment took place in October, while early voting in the off-year election was still ongoing, so there were no two separate sessions with an election in between as required, the GOPers said.<\/p>\n<aside class=\"single__inline-module aligncenter wp-block-nypost-editor-primary-tag\">\n<\/aside>\n<figure class=\"nyp-slideshow-modal-image wp-block-image aligncenter size-large\"><figcaption>It is difficult to gauge where Virginia\u2019s Supreme Court is leaning in the critical redistricting case. <span class=\"credit\">Getty Images<\/span><\/figcaption><\/figure>\n<p>The lower courts have been skeptical about whether Democrats complied with the procedures.<\/p>\n<p>But the Democrats\u2019 lawyer, Matthew Seligman, argued to the state\u2019s high court, \u201cThe General Assembly complied with every step that the Constitution requires.<\/p>\n<p>\u201cThe circuit court attempted to interfere with the democratic process by halting it,\u201d he said. \u201cThe challengers here now try to overturn the result of that democratic process.\u201d<\/p>\n<p>Right off the bat, a justice dismissed Seligman\u2019s argument about the people of Virginia deciding the referendum and underscored the irregularities of the process. <\/p>\n<p>The other justices who asked questions largely pushed Seligman over tougher procedural issues and generally had easier queries for the GOP\u2019s lawyer<\/p>\n<figure class=\"nyp-slideshow-modal-image wp-block-image aligncenter size-large\"><figcaption>Virginia\u2019s current map has allowed for a 6:5 Democrat to Republican split in the state\u2019s congressional delegation. <span class=\"credit\">Social Good Fund for Dave&#8217;s Redistricting<\/span><\/figcaption><\/figure>\n<p>Notably, fewer than half of the state\u2019s seven high court justices actually asked questions during oral arguments.<\/p>\n<p>Another procedural issue raised involved the General Assembly neglecting to publish the proposed amendment 90 days in advance, then retroactively repealing that regulation.<\/p>\n<p>\u201cThere are lots of voters across the Commonwealth who are not totally educated on everything going on in Richmond, and they need time,\u201d contended Thomas McCarthy, the lawyer repping the Republicans.<\/p>\n<p>\u201cThe Commonwealth needs time for the whole thing to be aired out,\u201d he said of the situation \u2014 which Republican National Committee Chairman Joe Gruters has called \u201ca blatant power grab.\u201d<\/p>\n<figure class=\"nyp-slideshow-modal-image wp-block-image aligncenter size-large\"><figcaption>The new map would favor Democrats for 10 out of Virginia\u2019s 11 congressional seats.  <span class=\"credit\">Social Good Fund for Dave&#8217;s Redistricting<\/span><\/figcaption><\/figure>\n<p>Democrats argued that the will of the voters shouldn\u2019t be tossed out on technicalities. They\u2019ve also contended that the Virginia Supreme Court shouldn\u2019t be weighing in on legislative rules.<\/p>\n<p>The referendum needed to temporarily allow the state legislature to redraw congressional districts instead of the constitutionally mandated bipartisan commission was approved in a 51.6% to 48.4% vote.<\/p>\n<p>Virginia currently has six Democrats and five Republicans in its congressional delegation. The state legislature\u2019s new map would create favorable conditions for a 10-1 split in favor of the Dems, though that\u2019s not guaranteed.<\/p>\n<p>It is very rare for courts to throw out a referendum result.<\/p>\n<\/p><\/div>\n<p><!-- \u603b\u5bb9\u5668\uff1a\u6700\u5927\u5bbd908px Grid\u7d27\u51d1\u5e03\u5c40 -->\r\n<div style=\"display: grid;
