Wade in June 2022.<\/p>\n<aside class=\"single__inline-module aligncenter wp-block-nypost-editor-primary-tag\">\n<\/aside>\n<p>Emails show the task force, led by civil division trial attorney Sanjay Patel, worked closely with Planned Parenthood Federation of America, Feminist Majority Foundation and the National Abortion Federation\u2019s Security Team to initiate investigations and \u201cmonitor\u201d pro-life activists \u2014 sometimes for years \u2014 before requesting arrest warrants and filing charges.<\/p>\n<p>In a Nov. 17, 2021, email, before the task force was launched, Patel had already praised NAF\u2019s security director, Michelle Davidson, to colleagues as an \u201cMVP\u201d at \u201cbringing incidents to my attention, often in real-time, which usually result in an investigation\/prosecution.\u201d<\/p>\n<p>The task force director was not nearly as chummy with defense counsel for one of the first pro-lifers indicted for illegally blocking access to an abortion clinic after the Dobbs decision, writing in a Feb. 22, 2023, email that he didn\u2019t \u201ckeep the kind of records\u201d the lawyer requested about the total number of \u201cprosecutions for vandalisms of pregnancy centers.\u201d<\/p>\n<figure class=\"nyp-slideshow-modal-image wp-block-image aligncenter size-large\"><figcaption>Mark Houck, a Catholic father of seven, was arrested in September 2022 by 16 armed FBI agents \u2014 some of whom were carrying long guns \u2014 at his home in rural Pennsylvania and charged with two FACE Act-related counts. <span class=\"credit\">Facebook\/Houck for Congress<\/span><\/figcaption><\/figure>\n<p>That was false, the Trump DOJ review found, since he had already forwarded \u201csubstantially identical information\u201d to NAF.<\/p>\n<p>Another case, US v. Zastrow, saw Biden DOJ prosecutors seeking \u201can indirect way to get some more info about religion without directly asking it,\u201d leading to a handful of Christian jurors being flagged \u201cfor peremptory and for-cause strikes from the jury pool because of their faith,\u201d according to draft voir dire documents and the subsequent review.<\/p>\n<p>Other draft documents from the Biden-era prosecutors referred to Christian pro-lifers as \u201cculty\u201d \u2014 before swapping out a less offensive term so as to appeal to the Catholic magistrate judge, who they griped had taken up the case.<\/p>\n<p>\u201cUnfortunately, we ended up with a very Catholic magistrate on duty this week and he was very particular about the bond conditions and not infringing on their first amendment rights,\u201d Assistant US Attorney Frances Lee Carlson wrote in a March 10, 2023, email.<\/p>\n<figure class=\"nyp-slideshow-modal-image wp-block-image aligncenter size-large\"><figcaption>Former Attorney General Merrick Garland set up a national task force to pursue cases against pro-lifers the month after the Supreme Court overturned Roe v. Wade in June 2022. <span class=\"credit\">Getty Images<\/span><\/figcaption><\/figure>\n<p>Patel also prodded his team following a Planned Parenthood referral to pursue what looked \u201clike a good felony FACE matter\u201d involving pro-life activist Mark Houck, per an Oct. 18, 2021, email on the day that he shoved an employee for the abortion advocacy group who harassed his son.<\/p>\n<p>More emails the following month point to Patel pushing for the indictment even as civil division attorneys expressed reservations \u2014 and did so again the following year in an Aug. 10, 2022, email that admitted there were still \u201clitigation risks.\u201d<\/p>\n<p>Houck, a Catholic father of seven, was later arrested in September 2022 by 16 armed FBI agents \u2014 some of whom were carrying long guns \u2014 at his home in rural Pennsylvania and charged with two FACE Act-related counts.<\/p>\n<p>The US Attorney\u2019s Office in the Eastern District of Pennsylvania had declined to pursue a summons allow him to self-surrender, but the public backlash caused Patel to place blame on the FBI.<\/p>\n<figure class=\"nyp-slideshow-modal-image wp-block-image aligncenter size-large\"><figcaption>Mark Houck with his son at Planned Parenthood clinic, with two clinic escorts in rainbow vests visible. <span class=\"credit\">JD Mullane\/Bucks County Courier Times \/ USA TODAY NETWORK<\/span><\/figcaption><\/figure>\n<p>The task force director claimed the \u201cmain reason\u201d for the public show of force was \u201cin hope of seizing phones\u201d pursuant to search warrants, an Oct. 4, 2022, email disclosed.<\/p>\n<p>\u201cI think the unspoken reason is bc the FBI really likes to make arrests,\u201d Patel added.<\/p>\n<p>The Biden DOJ also liked to seek higher prison sentences against pro-lifers charged with non-violent FACE Act violations.<\/p>\n<p>On average, its prosecutors sought 26.8 months in prison for pro-life defendants, compared with 12.3 months averaged for pro-abortion ones.<\/p>\n<figure class=\"nyp-slideshow-modal-image wp-block-image aligncenter size-large\"><figcaption>Houck was acquitted by a federal jury in January 2023 and later reached a settlement with the Biden DOJ. <span class=\"credit\">JD Mullane\/Bucks County Courier Times \/ USA TODAY NETWORK<\/span><\/figcaption><\/figure>\n<p>Judges also sentenced those pro-lifers at higher rates, 14 months to 3 months.<\/p>\n<p>President Trump, on his third day in office, signed pardons for 23 pro-lifers convicted of FACE Act violations under the prior administration, many of whom he said were \u201celderly\u201d and should not have been prosecuted.<\/p>\n<p>Houck was acquitted by a federal jury in January 2023 and later reached a settlement with the Biden DOJ<\/p>\n<p>\u201cThis Department will not tolerate a two-tiered system of justice,\u201d Acting Attorney General Todd Blanche said in a statement Tuesday. \u201cNo Department should conduct selective prosecution based on beliefs.\u201d<\/p>\n<figure class=\"nyp-slideshow-modal-image wp-block-image aligncenter size-large\"><figcaption>The prosecutions took place under Assistant Attorney General for Civil Rights Kristen Clarke. <span class=\"credit\">Getty Images<\/span><\/figcaption><\/figure>\n<p>\u201cThe weaponization that happened under the Biden Administration will not happen again, as we restore integrity to our prosecutorial system,\u201d he added.<\/p>\n<p>As a result of the lengthy review, the DOJ may also refer prosecutors or other employees currently facing internal misconduct probes for criminal prosecution, bar associations or other authorities.<\/p>\n<p>\u201cHere, internal referrals have been made as required by the Justice Manual,\u201d the report stated.<\/p>\n<p>Patel was fired Monday, a source familiar with his exit told The Post.
