They don\u2019t have that power,\u201d Mike Davis, a staunch Trump ally and founder of judicial advocacy group Article III Project, told The Post. \u201cWe the people never agreed to give this away.\u201d<\/p>\n<p>\u201cThese justices need to follow the law or they\u2019re going to lose their legitimacy,\u201d he added. \u201cThere\u2019s no more important of a case before the Supreme Court.\u201d<\/p>\n<p>Before the high court is a question of the legality of Trump\u2019s executive order to end so-called birthright citizenship that he signed during his very first day back in office last year.<\/p>\n<figure class=\"nyp-slideshow-modal-image wp-block-image aligncenter size-large\"><figcaption>The birthright citizenship case is widely seen as the most significant case left on the docket for the Supreme Court to hear this term. <span class=\"credit\">AP<\/span><\/figcaption><\/figure>\n<aside class=\"single__inline-module aligncenter wp-block-nypost-editor-primary-tag\">\n<\/aside>\n<figure class=\"nyp-slideshow-modal-image wp-block-image aligncenter size-large\"><figcaption>President Trump took executive action to end birthright citizenship for illegal immigrants on his very first day back in the White House. <span class=\"credit\">Getty Images<\/span><\/figcaption><\/figure>\n<p>Trump had toyed with the idea of tackling birthright citizenship during his first administration, but ultimately, that never came to fruition. At the time, even many conservative legal scholars were deeply skeptical that he could end birthright citizenship for illegal immigrants with the swipe of a pen.<\/p>\n<p>\u201cIt really used to be more of a fringe view that language could be reinterpreted in this way,\u201d Ming Hsu Chen, a law professor and director of the Race, Immigration, Citizenship, and Equality Program, University of California-San Francisco, said. <\/p>\n<p>\u201cI\u2019m a little surprised that the Supreme Court would take up this case on the merits, because on the merits, it seems like the decision is pretty clear,\u201d she added, referring to the textualist and precedential arguments against Trump\u2019s order. <\/p>\n<p>Birthright citizenship stems from the 14th Amendment, which stipulates that \u201call persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside.\u201d<\/p>\n<p>Trump\u2019s team has latched onto the word \u201cjurisdiction\u201d and argued that illegal immigrants aren\u2019t exactly subject to the jurisdiction of the US. They\u2019ve also pointed to the Supreme Court\u2019s ruling in the 1884 case Elk v. Wilkins, which states that the children of Native Americans aren\u2019t guaranteed birthright citizenship.<\/p>\n<p>\u201cChildren of temporarily present aliens or illegal aliens are not \u2018subject to\u2019 the United States\u2019 \u2018jurisdiction,\u2019 as the historical evidence\u2014especially from the critical juncture immediately surrounding ratification\u2014firmly shows,\u201d Trump\u2019s team wrote in its brief on the case. <\/p>\n<p>Congress later passed the Nationality Act of 1940 to guarantee the children of Native Americans citizenship. <\/p>\n<figure class=\"nyp-slideshow-modal-image wp-block-image aligncenter size-large\"><figcaption>Critics argue that birthright citizenship for illegal immigrants has fueled the border crisis in the past. <span class=\"credit\">James Keivom<\/span><\/figcaption><\/figure>\n<p>\u201cThe purpose of the Nationality Act was to gather all the rules about nationality to put them all in one place for comprehensiveness and clarity,\u201d Gerald Neuman, a professor at Harvard Law School, who specializes in immigration and constitutional law, said. <\/p>\n<p>Backers of the executive order argue that the Nationality Act of 1940 helps their case that there is more of a gray area in the 14th Amendment, while opponents contend that Trump is violating both the Constitution and statutory law. <\/p>\n<p>The Supreme Court is evaluating whether Trump\u2019s order complies with both that statute and the 14th Amendment. <\/p>\n<p>So far, every lower court that has looked at the executive order has deemed it illegal. The Supreme Court also dealt with a birthright citizenship question in the 1898 US v. Wong Kim Ark case, which revolved around the status of a man born to Chinese immigrants.<\/p>\n<p>The high court ruled in that man\u2019s favor and determined that almost all native born children automatically become citizens, with a few exceptions, such as foreign rulers, diplomats, and hostile foreign invaders. <\/p>\n<p>\u201cIt is incorrect to say that the \u2026 Wong Kim Ark decision has settled this question, because Wong Kim Ark involved lawful domiciled parents, and the case before the Supreme Court today involved temporary visitors or unlawfully present aliens,\u201d Ilhan Wurman, Professor of Law at the University of Minnesota, said.<\/p>\n<p>\u201cThe court has never actually addressed the meaning of the 14th Amendment as applied to the two categories of persons at issue in the Trump executive order,\u201d he added, referring to the children of illegal immigrants and temporary visitors.<\/p>\n<p>Some legal scholars believe that a major complication for Trump\u2019s effort to nix birthright citizenship for illegal immigrants is the fact that he used an executive order to end it. <\/p>\n<p>\u201cThere had been a theory that had been pushed as to how Congress could change the rule without amending the Constitution, but nobody had really been talking about the president having the authority to do this by executive order,\u201d Neuman said.<\/p>\n<p>\u201cIt\u2019s extremely solid,\u201d he added about the legal case against Trump\u2019s executive order. \u201cFirst of all, the precedent is very strong. And second of all, if you talk about it as a textualist, the key term in the Constitution is the arguments that are being put forward try to give jurisdiction a twisted meaning that it doesn\u2019t normally have.\u201d<\/p>\n<p>Wurman countered that presidents often have to \u201cinterpret the statutes for purposes of executing the law\u201d and that other presidents have had similarly controversial interpretations that the courts would later adjudicate.<\/p>\n<figure class=\"nyp-slideshow-modal-image wp-block-image aligncenter size-large\"><figcaption>Some analysts believe that the Supreme Court\u2019s taking up the merits of the birthright citizenship case is significant. <span class=\"credit\">REUTERS<\/span><\/figcaption><\/figure>\n<p>Critics of the existing birthright citizenship policy argue that it has made the US a magnet for illegal immigrants and has helped fuel the border crises America has weathered over the years. <\/p>\n<p>\u201cThere is no chance in hell that that was ever intended by the plain text or the original public meaning of the 14th Amendment to allow illegal aliens to have birthright citizenship,\u201d Davis contended. <\/p>\n<p>\u201cInvading armies don\u2019t get birthright citizenship. Foreign ambassadors\u2019 kids don\u2019t get birthright citizenship. Why the hell would Chinese birth tourists get birthright citizenship?\u201d<\/p>\n<p>Very few countries outside the Americas offer birthright citizenship as universal as the US does, to the point where illegal immigrants automatically become naturalized. Most of the ones that do aren\u2019t fully developed countries.<\/p>\n<p>\u201cWe have other important Supreme Court cases that have consistently held that the rights of children of undocumented immigrants are distinct from the rights of their parents,\u201d Ming countered. <\/p>\n<p>\u201cI think it falls outside the scope of what the law has allowed to be up for policy debate in terms of blaming the children or saddling the children with the consequences of their parents\u2019 actions.\u201d<\/p>\n<figure class=\"nyp-slideshow-modal-image wp-block-image aligncenter size-large\"><figcaption>President Trump previously fretted that the Supreme Court may rule against him in the birthright citizenship case. <span class=\"credit\">AFP via Getty Images<\/span><\/figcaption><\/figure>\n<p>Trump has signaled some nervousness that the Supreme Court could rule against him on the birthright citizenship case in light of the massive blow it dealt him on tariffs last month. <\/p>\n<p>\u201cBirthright Citizenship is not about rich people from China, and the rest of the World, who want their children, and hundreds of thousands more, FOR PAY, to ridiculously become citizens of the United States of America,\u201d Trump declared on Truth Social Monday. \u201cIt is about the BABIES OF SLAVES!\u201d<\/p>\n<p>\u201cWe are the only Country in the World that dignifies this subject with even discussion,\u201d the president went on. \u201cThe World is getting rich selling citizenships to our Country, while at the same time laughing at how STUPID our U.S. Court System has become (TARIFFS!)\u201d<\/p>\n<p>During its last term, the Supreme Court dealt with a peripheral issue in the birthright citizenship case about whether the lower courts could impose universal injunctions to block presidential actions, specifically Trump\u2019s order on birthright citizenship.<\/p>\n<p>Ultimately, the high court ruled in Trump\u2019s favor to nix universal injunctions, but the lower courts blocked his executive order when a challenge against it was refiled as a class action lawsuit. <\/p>\n<p>Justices did little to tip their hand about their thoughts on the merits of the case.<\/p>\n<\/p><\/div>\n<p><!-- \u603b\u5bb9\u5668\uff1a\u6700\u5927\u5bbd908px Grid\u7d27\u51d1\u5e03\u5c40 -->\r\n<div style=\"display: grid;
