launched by the Department of Justice.<\/p>\n<p>Harmeet Dhillon, Assistant Attorney General for Civil Rights at the U.S. Department of Justice, confirmed to the Post the DOJ will write to attorneys general in both states about the investigations.<\/p>\n<p>The investigation follows a billboard campaign launched across California by two women\u2019s rights groups demanding attention to a Are Real and WomaniiWoman, wants better scrutiny of biological male inmates housed in women\u2019s prisons under Senate Bill 132 \u2013 and drawing attention to the upcoming rape trial of\u00a0trans prisoner Tremaine Carroll.<\/p>\n<p>\u201cThese investigations will uncover whether the dangerous national trend of housing men in women\u2019s prisons has resulted in violations of women\u2019s constitutional rights,\u201d Dhillon said in a statement. <\/p>\n<aside class=\"single__inline-module aligncenter wp-block-nypost-editor-primary-tag\">\n<\/aside>\n<p>Carroll was in Central California Women\u2019s Facility in Chowchilla because\u00a0of SB 132, passed in 2021, allowing allowing transgender, nonbinary, and intersex inmates to be housed according to their gender identity.<\/p>\n<p>The California Department of Corrections and Rehabilitation claims requests are reviewed by a classification committee rather than granted automatically.<\/p>\n<p>Formally known as the\u00a0Transgender Respect, Agency and Dignity Act, it allows inmates to be housed based solely on their stated gender identity. Critics of the law say this enables male prisoners to exploit the system in order to be housed with women. <\/p>\n<p>Carroll, 52, has been charged with raping three woman while imprisoned in the Central California Women\u2019s Facility in Chowchilla. Prosecutors say one female cellmate became pregnant.<\/p>\n<figure class=\"wp-block-image aligncenter size-large\"><button class=\"button button--modal-trigger\" aria-label=\"Open the image in a State-Sanctioned Rape \u2013 Media Silent.\u201d<\/p>\n<p>The DOJ has not yet reached any conclusions on the rape claims, the department noted in a press release. <\/p>\n<p>Its investigation in California will focus on Central California Women\u2019s Facility and California Institution for Women, located in San Bernardino County. The justice department will probe whether practices around transgender inmates violates the Civil Rights of Institutionalized Persons Act, according to a press release. <\/p>\n<p>\u201cCalifornia\u2019s Transgender Respect, Agency, and Dignity Act has provided none of these<br \/>qualities to the female inmates of state prisons who have been forced to share space with<br \/>biological men who are violent felons,\u201d added First Assistant United States Attorney Bill<br \/>Essayli of the Central District of California in a statement.<\/p>\n<p>The DOJ said it is also gathering info on trans prison inmates anywhere in the country.<\/p>\n<p>In February, a Madera County judge has ruled Tremaine Carroll must be referred to using she\/her\u00a0pronouns because Carroll identifies as a woman.<\/p>\n<p>Madera County District Attorney Sally Moreno slammed the decision, saying Moreno is abusing California\u2019s prison housing law and said the pronoun ruling risks confusing jurors and complicating the prosecution.\u00a0<\/p>\n<p>\u201cThis is a particular issue in this case because it\u2019s confusing to the jury. In California, rape is a crime that has to be accomplished by a man,\u201d Moreno told ABC7.<\/p>\n<p>\u201cThere\u2019s no psychological evaluation required. This person does not need to be on cross-gender hormones. They don\u2019t need to be signed up for transgender surgery. They don\u2019t need a psychological evaluation regarding gender confusion.
