Immigration advocacy groups countered that \u201ca person arrives in the United States at a port of entry when they are at the threshold of the port\u2019s entrance, about to step over.\u201d<\/p>\n<p>\u201cYou can\u2019t arrive in the United States while you\u2019re still standing in Mexico. That should be the end of this case,\u201d Vivek Suri, assistant to the US Solicitor General, argued. <\/p>\n<p>Most of the Republican-appointed justices, and at times, Democrat appointed Justice Elena Kagan, a self-described textualist, appeared sympathetic to the Trump administration\u2019s interpretation.<\/p>\n<p>\u201cI think that\u2019s consistent with ordinary meaning,\u201d Kelsi Corkran, an attorney representing immigrant rights organizations, argued. \u201cI arrive at my house, or I arrive in my yard when I\u2019m going through the gate.\u201d<\/p>\n<p>\u201cNow that process of arriving is interrupted by the border officer physically blocking them from completing the arrival,\u201d she added. \u201cBut the process of arriving is beginning at that moment.\u201d<\/p>\n<p>Corkran stressed that \u201cCongress used the present tense\u201d in that statute intentionally to convey that it was referring to people in the process of arriving in the US. She also argued that because \u201cthe border wall is entirely on the interior\u201d of the US, \u201canyone who gets to the border wall\u201d is physically in the country. <\/p>\n<p>Republican-appointed Justice Samuel Alito zeroes in on whether there is a difference between \u201carrive at\u201d and \u201carrive in\u201d a location.<\/p>\n<p>\u201cDo you think someone who comes to the front door of a house and knocks at the door has arrived in the house? The person may have arrived at the house,\u201d he asked. <\/p>\n<p>Corkran argued there wasn\u2019t much of a distinction, brushing it off as basic rules for prepositional phrases and \u201cthe way we talk.\u201d<\/p>\n<figure class=\"nyp-slideshow-modal-image wp-block-image aligncenter size-large\"><figcaption>Republican-appointed Justice Brett Kavanaugh made clear he doesn\u2019t want material in parentheses in statutes to be ignored. <span class=\"credit\">REUTERS<\/span><\/figcaption><\/figure>\n<p>Tedious grammar questions dominated Tuesday\u2019s oral arguments. At one point, Republican-appointed Justice Brett Kavanaugh ripped into the Trump administration.<\/p>\n<p>\u201cThis is a relatively minor point,\u201d he said. \u201cYou say that because it\u2019s in a parenthetical, it\u2019s different than if it had been separated by commas or dashes. Do you really mean that?\u201d<\/p>\n<p>Suri stood by that, but said the Supreme Court doesn\u2019t need to rely on that argument. <\/p>\n<figure class=\"nyp-slideshow-modal-image wp-block-image aligncenter size-large\"><figcaption>Democrat-appointed Justice Ketanji Brown Jackson effectively wanted to punt on the case. <span class=\"credit\">Getty Images<\/span><\/figcaption><\/figure>\n<p>Democrat-appointed Justice Ketanji Brown Jackson repeatedly pushed for the Supreme Court to simply vacate or scrap the lower court ruling blocking the metering policy and refrain from ruling on the merits of the challenge. <\/p>\n<p>She argued that the Supreme Court isn\u2019t supposed to delve into the merits of hypothetical cases and should hold off on the merits until an actual metering policy is in place.<\/p>\n<p>A decision in Noem, Sec. of Homeland v.
