says feature an artificial intelligence clone of his \u201clustrous\u201d baritone, with a verdict due on Wednesday.<\/p>\n<p>AI imitation is a growing concern among performers worldwide, and the threat has roiled Japan\u2019s storied animation industry, whose voice actors are sometimes worshipped as much as their characters by fans.<\/p>\n<p>The lawsuit filed by Kenjiro Tsuda, known for his starring roles in mega-franchises including \u201cJujutsu Kaisen\u201d and \u201cYu-Gi-Oh!\u201d, is believed to be the country\u2019s first seeking to defend an individual\u2019s vocal identity against AI-generated copies.<\/p>\n<p>Tsuda is demanding TikTok remove a slew of videos narrated by a distinctively \u201cdeep\u201d and \u201clustrous\u201d voice that the 55-year-old says can only be his.<\/p>\n<p>The platform however argues it is a \u201cgeneric male voice\u201d \u201cgeneric male voice\u201d whose perceived similarity to Tsuda\u2019s is subjective at best, according to court records accessed by AFP.<\/p>\n<p>An actor\u2019s voice \u201cis the result of years of rigorous training and apprenticeship\u201d to hone talent, Yuko Sasaki, executive director of the Japan Actors Union, told AFP.<\/p>\n<p>\u201cIt\u2019s something we spend lots of time and money perfecting,\u201d said Sasaki, a fellow voice actor, adding that \u201cwe support Tsuda wholeheartedly\u201d.<\/p>\n<p>The court should \u201cacknowledge that ownership of a voice is a fundamental right\u201d, she said.<\/p>\n<p>An anonymous account, whose picture resembled a \u201cJujutsu Kaisen\u201d character dubbed by Tsuda, posted the videos in question.<\/p>\n<p>They combined images and seemingly AI-generated speech about urban legends, occult phenomena and conspiracy theories.<\/p>\n<p>The account at one point boasted more than 200,000 subscribers and would have brought in upwards of 500,000 yen ($3,200) in monthly revenue, the legal complaint argued.<\/p>\n<p>\u2013 \u2018Sordid content\u2019 \u2013<\/p>\n<p>The account, whose posts mostly lacked original substance, \u201conly gained popularity because its dubious, sordid content was narrated by the attractive voice of a popular actor,\u201d Tsuda\u2019s legal team said, according to the court records.<\/p>\n<p>This infringes Tsuda\u2019s so-called publicity rights \u2014 the ability to control and profit from the use of aspects of one\u2019s identity \u2014 his attorneys said.<\/p>\n<p>Although the account itself is no longer viewable on the platform, the Tokyo District Court will rule on whether TikTok was responsible for deleting the posts.<\/p>\n<p>Parallel to the lawsuit, Sasaki and other Japanese voice actors have launched a campaign, called \u201cNo More\u201d, against using generative AI to mimic performers without permission.<\/p>\n<p>\u201cOur industry can be crushed\u201d if a court win for TikTok triggers \u201cunbridled\u201d AI voice cloning on social media, actor Bin Shimada told AFP.<\/p>\n<p>That could cause younger actors to \u201close hope\u201d, said Shimada, who is part of the campaign group.<\/p>\n<p>It is also fast becoming a global issue.<\/p>\n<p>\u201cIn many countries copyright and data protection laws are not being adequately adapted\u201d to protect performers from AI clones, the International Federation of Actors said last year.<\/p>\n<p>ChatGPT maker OpenAI was forced to apologise in 2024 to star Scarlett Johansson over a synthetic voice that sounded like her, released after she declined to work with OpenAI on the project.<\/p>\n<p>\u2013 International interest \u2013<\/p>\n<p>While no law explicitly enshrines a person\u2019s voice in Japan, the justice ministry published legally non-binding guidelines last month clarifying its protection under existing rights.<\/p>\n<p>As \u201cthe symbol of one\u2019s personality\u201d voice is subject to \u201cpublicity rights\u201d and \u201crights to prevent unauthorised use of one\u2019s portrait and likeness\u201d, the ministry said.<\/p>\n<p>But it remains to be seen whether and how the guidelines will influence Wednesday\u2019s court decision on Tsuda\u2019s case.<\/p>\n<p>TikTok has questioned the actor\u2019s \u201cnational fame\u201d, rejecting his accusations that the account was free-riding on a well-known brand in a violation of Japan\u2019s unfair competition prevention laws.<\/p>\n<p>As a platform, all it did was \u201chost a forum where users could post creative and ingenious content within the scope of free speech,\u201d it told the court.<\/p>\n<p>It is \u201cvery unlikely\u201d that Tsuda\u2019s voice will be outright denied publicity rights, Tatsuhiro Ueno, a professor of intellectual property studies at Waseda University, told AFP.<\/p>\n<p>Given the actor\u2019s \u201cJujutsu Kaisen\u201d role as a stoic, elite sorcerer that made his voice \u201chighly recognisable in Europe\u201d, Ueno believes the verdict \u201cwill garner a lot of international interest\u201d.<\/p>\n<p>Veteran voice actor Michihiro Ikemizu, 83, also expressed solidarity with Tsuda \u2014 but said that AI, however sophisticated it gets, will never outperform human actors.<\/p>\n<p>\u201cYou need to constantly feel and adapt while performing your role.
