Canadian judges have repeatedly emphasised that digital evidence must be authenticated and shown to be reliable before it can be relied upon. That requirement becomes especially important in the AI era.<\/p>\n<p class=\"wp-block-paragraph\">If a Canadian prosecution were to centre on allegations that an audio recording had been synthetically generated, courts would likely expect robust forensic evidence supporting that conclusion. Assertions that content merely appears suspicious or unnatural would almost certainly be insufficient. The lesson from New Hampshire is therefore entirely consistent with Canadian legal traditions: technological claims require demonstrable proof.<\/p>\n<p class=\"wp-block-paragraph\">The implications extend well beyond criminal courts. Businesses across Canada are increasingly concerned about AI-enabled impersonation. Fraudsters have already demonstrated the ability to clone executive voices, mimic trusted suppliers and create convincing synthetic communications designed to bypass traditional verification procedures.<\/p>\n<p class=\"wp-block-paragraph\">Financial institutions, pharmaceutical companies and healthcare organisations have all identified synthetic-media fraud as a growing threat to operational security. For organisations, the New Hampshire case reinforces the importance of evidence preservation and digital governance. If a suspected deepfake emerges within a business environment, organisations may need to preserve metadata, document chain-of-custody information and engage qualified forensic specialists capable of determining whether manipulation has occurred.<\/p>\n<p class=\"wp-block-paragraph\">Without that evidence, legal remedies may be difficult to pursue. This represents a significant shift in organisational risk management. Historically, identifying fraudulent content was often the primary challenge.
