Jackson Women\u2019s Health, in which the court struck down Roe v. Wade \u2014 was staggered by hypothetical questions from conservative justices while defending a Magnolia State law allowing the counting of mail-in ballots up to five days after voting closes, so long as they are postmarked by Election Day.<\/p>\n<p>After Trump-nominated Justice Amy Coney Barrett pressed Stewart about whether states could allow voters to recall mailed ballots before Election Day, liberal Justice Ketanji Brown Jackson intervened.<\/p>\n<figure class=\"nyp-slideshow-modal-image wp-block-image aligncenter size-large\"><figcaption>The liberal justices helped throw a lifeline to Mississippi\u2019s solicitor general during bruising questioning from the conservative justices.  <span class=\"credit\">Getty Images<\/span><\/figcaption><\/figure>\n<p>\u201cThis case is not about a Mississippi practice or policy related to recalling ballots,\u201d said Jackson, who added that she was \u201ca little confused about those kinds of policy questions.\u201d<\/p>\n<p>The newest justice told Stewart that the longtime practice of allowing states to run their own elections \u201cactually is pointed in your favor.\u201d<\/p>\n<p>The unique case pitted the red state of Mississippi against the Republican National Committee, state Libertarian Party, and Trump administration, all of whom opposed the pandemic-era policy.<\/p>\n<aside class=\"single__inline-module aligncenter wp-block-nypost-editor-primary-tag\">\n<\/aside>\n<p>At least 14 other states have similar laws \u2014 including California, New York and Texas. Nearly 30 states have grace periods for absentee ballots, which are most often used by the military and US citizens overseas.<\/p>\n<p>In another exchange, Justice Neil Gorsuch asked Stewart whether states could allow a voter to film themselves postmarking a ballot on Election Day, then have their brother submit it three weeks later.<\/p>\n<p>\u201cWhy do you fight the premise?\u201d Justice Sonia Sotomayor interjected after the Mississippian admitted he had \u201csome concerns\u201d about that scenario.<\/p>\n<p>\u201cIf the state wants to make [a relative] a notary \u2026 a military officer, if it wants to make it a Supreme Court justice, if it wants to make it anyone, as long as it\u2019s done by Election Day, that\u2019s what\u2019s counts, correct?\u201d she contined.<\/p>\n<figure class=\"nyp-slideshow-modal-image wp-block-image aligncenter size-large\"><figcaption>Mississippi\u2019s GOP-led state legislation unanimously implemented its mail-in ballot policy during the COIVD-19 pandemic. <span class=\"credit\">Paul Martinka<\/span><\/figcaption><\/figure>\n<figure class=\"nyp-slideshow-modal-image wp-block-image aligncenter size-large\"><figcaption>Republican-appointed Justice Neil Gorsuch asked some of the toughest questions during Monday\u2019s oral arguments.  <span class=\"credit\">AP<\/span><\/figcaption><\/figure>\n<figure class=\"nyp-slideshow-modal-image wp-block-image aligncenter size-large\"><figcaption>Over a dozen states have lax mail-in-ballot policies similar to Mississippi. <span class=\"credit\">Michael Nagle<\/span><\/figcaption><\/figure>\n<p>Conservative Justice Samuel Alito then told Stewart that Sotomayor was \u201casking you what, I think, she intends to be a friendly question.\u201d<\/p>\n<p>All three Democrat-appointed justices sounded sympathetic to Mississippi, while conservative justices Gorsuch, Alito, Clarence Thomas, and Brett Kavanaugh appeared to lean towards overturning the state law.<\/p>\n<p>Paul Clement, representing the Libertarian Party of Mississippi, argued that by setting the first Tuesday after the first Monday in November as a national Election Day in 1845, Congress inherently required that voting wrap up on that day.<\/p>\n<figure class=\"nyp-slideshow-modal-image wp-block-image aligncenter size-large\"><figcaption>The Supreme Court is expected to make a decision in Watson v. RNC by the end of June. <span class=\"credit\">REUTERS<\/span><\/figcaption><\/figure>\n<p>\u201cIf somebody in Gulfport the day after the election asks, \u2018Is the election over?\u2019 the common sense answer is, \u2018No it\u2019s not, the ballots are still coming in,\u201d Clement argued. \u201cThat reality gives the lie to the idea that we have a uniform national election day.\u201d<\/p>\n<p>At the same time, the attorney insisted he was not arguing to make early voting illegal, a point with which all sides agreed.<\/p>\n<p>The case, Watson v. RNC, comes amid President Trump\u2019s push for Congress to tighten restrictions on mail-in ballots and enact a proof of citizenship requirement to vote in federal elections as part of the Safeguard American Voter Eligibility (SAVE) America Act, which faces an uphill battle in the Senate.<\/p>\n<p>A decision is expected by the end of June.<\/p>\n<\/p><\/div>\n<p><!-- \u603b\u5bb9\u5668\uff1a\u6700\u5927\u5bbd908px Grid\u7d27\u51d1\u5e03\u5c40 -->\r\n<div style=\"display: grid;
