This lawsuit does the opposite,\u201d OpenAI\u2019s lawyers say in their filing, which continues to describe Apple\u2019s complaint as \u201crotten to its core.\u201d<\/p>\n<p>Federal judge Edward Davila will consider both requests at a hearing on October 1.\u00a0<\/p>\n<p>\u2013 Partners and rivals \u2013<\/p>\n<p>Meanwhile, the two companies remain partners, since ChatGPT has been integrated into Apple products since 2024.<\/p>\n<p>\u201cApple should not be permitted to use a baseless and pretextual lawsuit to make up for its shortcomings in the market for talent and retaining its employees, and its failures to integrate AI into its products,\u201d OpenAI\u2019s lawyers say.\u00a0<\/p>\n<p>They invoke California laws that \u201cencourage\u201d employees to take new jobs \u2013 policies that are \u201ccredited with powering the tech revolution that has made companies based in this state the envy of the world.\u201d\u00a0<\/p>\n<p>More than 400 former Apple employees currently work at OpenAI, according to the initial complaint.<\/p>\n<p>\u201cThe harm is happening now,\u201d Apple\u2019s lawyers say, and \u201cevery day that passes without an injunction allows OpenAI to embed their knowledge of Apple\u2019s stolen information into its hardware development efforts.\u201d\u00a0<\/p>\n<p>\u2013 Smart speaker \u2013<\/p>\n<p>To convince the judge of the urgency, Apple\u2019s lawyers submitted a TechCrunch article describing leaked details about OpenAI\u2019s highly anticipated first device: a screenless smart speaker designed in collaboration with LoveFrom, a studio founded by Jony Ive, Apple\u2019s famed former head of design.<\/p>\n<p>On Thursday, Bloomberg reported that the device would be circular like a donut, about the size of a hockey puck, and cost between $300 and $400, with a launch planned for 2027.<\/p>\n<p>OpenAI has never confirmed these leaks.<\/p>\n<p>\u201cOpenAI has no use, need or desire for Apple\u2019s trade secrets,\u201d the creator of ChatGPT says in a court document, which continues that Apple hasn\u2019t named any specific products, such as an iPhone, that has allegedly been copied. \u201cOpenAI is building something entirely new and different.\u201d<\/p>\n<p>Apple, for its part, accuses OpenAI\u2019s head of hardware Tang Tan, a former vice president of design at Apple, of using his knowledge of unreleased Apple products to extract information from job candidates.\u00a0<\/p>\n<p>OpenAI asked candidates to bring \u201cprototypes\u201d and design files to interviews for \u201cshow and tell\u201d sessions, an American classroom exercise where students present objects to their classmates, Apple alleges.\u00a0<\/p>\n<p>In its response, OpenAI says it follows standard industry practices.\u00a0<\/p>\n<p>According to his lawyers, Tan \u201crepeatedly instructed recruits and his team not to bring or disclose former employers\u2019 confidential information.\u201d\u00a0<\/p>\n<p>OpenAI also defends itself by accusing Apple of failing to properly protect its own data, claiming that the Cupertino company has \u201cencouraged employees to use personal iCloud accounts for work, intermingling company and personal data, while failing to manage access cleanly across multiple Apple systems when employees departed.\u201d<\/p>\n<p>The case comes at a sensitive time for OpenAI, which is worth a reported $852 billion as it works towards a potential IPO.
