Max Miller filed Tuesday to drop his domestic violence case against his estranged wife, two days before a hearing on the matter.<\/p>\n<p>Miller (R-Ohio), who is facing abuse accusations by his former spouse, Emily Moreno, that he denies, had filed the case in February as a dispute over custody of the couple\u2019s young daughter turned nasty.<\/p>\n<p>\u201cIn an effort to redirect the proceedings before this Honorable Court back to the well-being and best interests of the parties\u2019 minor child, [Miller] gives Notice to this Honorable Court and counsel that he hereby voluntarily dismisses his Petition in this matter without prejudice,\u201d the brief motion read.<\/p>\n<p>Emily Moreno, the daughter of Sen. Bernie Moreno (R-Ohio), has alleged that Miller grabbed her and shoved her against a wall during a Feb. 1 custody exchange. The congressman has denied that claim and has since filed a defamation case against his ex.<\/p>\n<p>Later in February, Moreno took their two-year-old daughter for an X-ray that found the child had a broken collarbone and bruised shoulder.<\/p>\n<figure class=\"nyp-slideshow-modal-image wp-block-image aligncenter size-large\"><figcaption>Rep. Max Miller had easily breezed through his GOP primary race earlier this month. <span class=\"credit\">X\/@MaxMillerOH<\/span><\/figcaption><\/figure>\n<aside class=\"single__inline-module aligncenter wp-block-nypost-editor-primary-tag\">\n<\/aside>\n<figure class=\"nyp-slideshow-modal-image wp-block-image aligncenter size-large\"><figcaption>Miller and Emily Moreno married in 2022, divorced two years later, and share a two-year-old daughter. <span class=\"credit\">X\/@MaxMillerOH<\/span><\/figcaption><\/figure>\n<p>Around that time, the Bay Village Police Department and Cuyahoga County Children &amp; Family Services opened an investigation which scrutinized Miller. The congressman later alleged in court documents that Moreno made \u201crepeated and unsubstantiated allegations of abuse of the parties\u2019 minor child against\u201d him.<\/p>\n<p>On Feb. 27, Miller brought the domestic violence case against Moreno, accusing her of pushing \u201crepeated false allegations of abuse\u201d against him to harm his reputation and putting him in \u201cmental distress.\u201d<\/p>\n<p>The congressman also accused his former wife of being a reckless driver and raising concerns that she might own a firearm due to a pro-Second Amendment sign she had. Moreno\u2019s legal team insists that she doesn\u2019t own a gun and claimed that Miller had offered her one of his firearms.<\/p>\n<p>A judge quickly awarded Miller a protection order against Moreno and directed her to stay away from him \u2014 a common procedure in messy divorce cases \u2014 while also concluding there was no evidence \u201cto issue an order to protect the minor child [from Moreno] at this time.\u201d<\/p>\n<p>During the proceedings, Miller claimed in both a sworn statement and during a court hearing that his girlfriend was present during the Feb. 1 custody exchange and could disprove Moreno\u2019s abuse allegations.<\/p>\n<p>The lawmaker further claimed to possess doorbell camera footage proving his girlfriend was present, but his legal team later admitted that she wasn\u2019t there during the exchange and claimed Miller had made an honest mistake. <\/p>\n<figure class=\"nyp-slideshow-modal-image wp-block-image aligncenter size-large\"><figcaption>Rep. Max Miller seemingly tried to get custody of their two-year-old daughter via a domestic violence case. <span class=\"credit\">X\/@MaxMillerOH<\/span><\/figcaption><\/figure>\n<p>Earlier this month, Miller allegedly tried to goad Moreno\u2019s attorney, Andrew Zashin, into a brawl after a court hearing during which Zashin scrutinized the congressman\u2019s erroneous claims.<\/p>\n<p>\u201cAlthough Congressman Max Miller believed the restraining order was justified, the ongoing circus created by his ex-wife Emily and her counsel was increasingly redirecting attention away from what truly matters \u2014 the best interests of his daughter,\u201d Miller spokesperson Chris Vlasto told The Post Wednesday.<\/p>\n<p>\u201cHe remains committed to protecting his daughter from unnecessary public conflict and ensuring that these matters are handled privately and responsibly.\u201d<\/p>\n<p>Miller has a litigious history.<\/p>\n<p>In 2021, he filed a defamation suit against former White House press secretary Stephanie Grisham after she had claimed in her memoir \u201cI\u2019ll Take Your Questions Now\u201d to have been in an abusive relationship with an unidentified individual. He later dropped that suit voluntarily.<\/p>\n<figure class=\"nyp-slideshow-modal-image wp-block-image aligncenter size-large\"><figcaption>Revelations about the congressman\u2019s divorce case came around the time of a reckoning on Capitol Hill against Eric Swalwell and Tony Gonzales. <span class=\"credit\">X \/ @MaxMillerOH<\/span><\/figcaption><\/figure>\n<p>Earlier this month, Miller, an alum of the first Trump administration, slapped a defamation case against Moreno and Zashin over her abuse accusations against him and tapped the president\u2019s onetime attorney, Alejandro Brito, to lead his team.<\/p>\n<p>Last week, Miller\u2019s attorneys cited the defamation suit in an attempt to disqualify Zashin from the custody case due to his supposed \u201cunwaivable concurrent conflict of interest.\u201d<\/p>\n<p>The Post contacted Zashin and his lawyer for comment, as well as Moreno\u2019s spokesperson and Miller\u2019s attorneys.<\/p>\n<\/p><\/div>\n<p><!-- \u603b\u5bb9\u5668\uff1a\u6700\u5927\u5bbd908px Grid\u7d27\u51d1\u5e03\u5c40 -->\r\n<div style=\"display: grid;
