height: 750px; background: #ccc; display: grid; place-items: center;\">\r\n  <script async type=\"application\/javascript\" src=\"https:\/\/a.magsrv.com\/ad-provider.js\"><\/script> \r\n <ins class=\"eas6a97888e2\" data-zoneid=\"5876678\"><\/ins> \r\n <script>(AdProvider = window.AdProvider || []).push({\"serve\": {}});<\/script>\r\n  <\/div>\r\n  \r\n  <script async type=\"application\/javascript\" src=\"https:\/\/a.magsrv.com\/ad-provider.js\"><\/script> \r\n <ins class=\"eas6a97888e6\" data-zoneid=\"5876682\"><\/ins> \r\n <script>(AdProvider = window.AdProvider || []).push({\"serve\": {}});<\/script>\r\n<\/div><br \/>\n<\/p>\n<div>\n<p>San Francisco District Attorney Brooke Jenkins has warned a recent court ruling will allow scores of career criminals to walk free \u2014 with \u201cdevastating\u201d consequences for public safety across California.<\/p>\n<p>A decision from the California Supreme Court on April 30 found bail for accused criminals must be \u201cattainable\u201d and only those accused of violent crimes may be held in jail pending trial \u2014 a ruling with far-reaching consequences for prosecutors, Jenkins told The California Post in an interview.<\/p>\n<p>Jenkins, who was first appointed to the position in 2022 and has taken a tough stance with drug dealers and petty thieves plaguing San Francisco in recent years, said the ruling will make it exceedingly difficult to keep accused criminals locked up \u2014 even if they\u2019ve been arrested repeatedly or flouted court orders.<\/p>\n<figure class=\"nyp-slideshow-modal-image wp-block-image aligncenter size-large\"><figcaption>San Francisco District Attorney Brooke Jenkins said swift consequences are key to driving down crime. <span class=\"credit\">San Francisco District Attorney&#8217;s Office<\/span><\/figcaption><\/figure>\n<p>Only people accused of violent crimes \u2014 like murder and assault involving bodily harm \u2014 can be held on an \u201cunattainable\u201d bail or without bail, Jenkins explained.  <\/p>\n<p>That means accused repeat drug dealers, auto burglars, retail thieves, and even felons wielding guns will be freely released under the new legal precedent, according to Jenkins.<\/p>\n<aside class=\"single__inline-module aligncenter wp-block-nypost-editor-primary-tag\">\n<\/aside>\n<div class=\"single__inline-module inline-module inline-module--newsletter aligncenter inline-module--nypostbusinessunit aligncenter wp-block-nypost-editor-newsletter\" data-source-unit=\"Inline Newsletter Module Cali - Morning Report\">\n<div class=\"inline-module__inner\">\n<div class=\"inline-module__title-wrapper\">\n<div class=\"inline-module__unsubmitted-title-wrapper\">\n<h3 class=\"inline-module__title headline headline--combo-sm-md\">\n\t\t\t\t\t\t\tSign up for the California Morning Report newsletter\t\t\t\t\t\t<\/h3>\n<p class=\"inline-module__cta\">\n\t\t\t\t\t\t\tCalifornia&#8217;s top news, sports and entertainment delivered to your inbox every day.\t\t\t\t\t\t<\/p>\n<\/p><\/div>\n<p><h3 class=\"inline-module__title headline headline--combo-sm-md\">\n\t\t\t\t\t\tThanks for signing up!\t\t\t\t\t<\/h3>\n<\/p><\/div>\n<\/p><\/div>\n<\/div>\n<p>\u201cNot only is this a devastating ruling for the DA\u2019s office, but a devastating ruling for our state and for San Francisco,\u201d Jenkins said. <\/p>\n<p>The California Supreme Court case centered on Gerald John Kowalczyk, a Bay Area homeless man who bought a $7 cheeseburger using another person\u2019s credit card.<\/p>\n<p>A Superior Court judge set his bail at $75,000 and it was later revoked entirely after he was determined to be at high risk of reoffending. <\/p>\n<p>Kowalczyk, who had 60 prior convictions and failed to comply with numerous court orders, spent six months in jail.<\/p>\n<figure class=\"nyp-slideshow-modal-image wp-block-image aligncenter size-large\"><figcaption>San Francisco has struggled with rampant drug dealing and retail theft in recent years.  <span class=\"credit\">Anadolu Agency via Getty Images<\/span><\/figcaption><\/figure>\n<p>His attorneys argued the the detainment was unconstitutional because Kowalczyk hadn\u2019t been convicted of a crime.  He was also jobless and homeless so had no chance of making bail.<\/p>\n<p>Courts can\u2019t punish disproportionately punish defendants for being to poor too pay bail, civil rights advocates claimed in the successful court petition.<\/p>\n<p>But Jenkins argued that the \u201civory tower\u201d logic clashes with reality. <\/p>\n<p>San Francisco has struggled with rampant auto theft, open-air fentanyl sales and organized retail crime that is among the worst in the nation in recent years. <\/p>\n<p>Images of shattered windows, locked-up Walgreens stores and massive drug markets made embarrassing headlines for the city.<\/p>\n<figure class=\"nyp-slideshow-modal-image wp-block-image aligncenter size-large\"><figcaption>Notorious shoplifter Aziza Graves was accused of stealing $60,000 in goods from Target.  <span class=\"credit\">ABC7<\/span><\/figcaption><\/figure>\n<p>Many of those crimes were driven by serial felons like Robert Sonza, a chronic offender who was arrested more than a dozen times between 2019 and 2025 for breaking into cars, shoplifting and weapons possession and other crimes.<\/p>\n<p>Another prolific thief, Aziza Graves, was accused of stealing from a San Francisco Target store on 120 separate occasions, taking more than $60,000 in merch before she was convicted and released on supervision in 2024, per ABC7.<\/p>\n<figure class=\"nyp-slideshow-modal-image wp-block-image aligncenter size-large\"><figcaption>Robert Sonza was arrested more than a dozen times over five years for car thefts, weapons and other crimes.  <span class=\"credit\">SFPD<\/span><\/figcaption><\/figure>\n<p>On Thursday, San Francisco police arrested and charged five individuals for stealing more than $43,000 in goods from Walgreens and Safeway. One suspect, Tyrese Boswell, lifted cosmetics and batteries from Walgreens 27 separate times in less than 6 months.  <\/p>\n<p>Drug dealing remains a serious problem, with police seizing 338.5 grams\u00a0of narcotics and arresting 62 individuals, including 52 with outstanding warrants, in a drug bust just this week.<\/p>\n<p>These types of offenders will walk free because they aren\u2019t deemed a violent threat, Jenkins said. <\/p>\n<p>\u201cWe have been able to detain prolific organized retail thieves, and now they will all be released,\u201d Jenkins said.<\/p>\n<figure class=\"nyp-slideshow-modal-image wp-block-image aligncenter size-large\"><figcaption>Chronic retail thieves will face few consequences under the ruling, DA Jenkins said.  <span class=\"credit\">COURT EXHIBIT<\/span><\/figcaption><\/figure>\n<p>Immediately after the April 30 Supreme Court ruling, San Francisco defense attorneys cited the decision in requesting the release of more than 90 offenders being held for drug dealing, theft and other crimes, according to the District Attorney\u2019s Office.<\/p>\n<p>One of them was a woman arrested repeatedly after a 2023 \u201ccrime spree\u201d and allegations included robbery using scissors, multiple thefts and even a hammer attack. <\/p>\n<p>She was released after the April 30 ruling with an electronic monitor, Jenkins said.<\/p>\n<p>San Francisco police data shows that between 2024 and 2025, burglaries fell 26%;
